Which Criminal Law Applies During Qatar Cases?

Last updated 7/1/20260 viewsProvisional

Qatar applies the law in force when an offence occurred, but if the law changes before final judgment, the more favourable version applies to you.

Generally, Article 9 of the Qatar Penal Code establishes that the law in force at the time the offence was committed is the one that applies. However, there is an important and expat-friendly exception: if the law changes before a final judgement is issued in your case, the version of the law that is more favourable to you will apply. This means that if a new law reduces the penalty for your offence, you may benefit from the lighter punishment.

There are exceptions to this principle. Under Article 10, if a new law is introduced specifically to address temporary or exceptional circumstances — and is explicitly stated to be such — it will apply for its intended duration regardless of whether it is more or less favourable. Once that temporary law expires, the previous law may resume. This is relatively uncommon but important to be aware of.

Article 11 adds another nuance: if your offence is continuous, successive, or habitual in nature (for example, an ongoing fraud or repeated violations), and you were still committing it when a new law came into force, the new law will apply to your case. The practical advice for expats is to work closely with a qualified Qatari criminal defence lawyer who can track any legislative changes and ensure you receive the most favourable applicable law throughout your proceedings.

This is general legal information, not legal advice. For advice on your specific situation, consult a lawyer licensed in Qatar.
